Terms of Use

General

These General Terms and Conditions of Business (hereinafter referred to as the "Terms of Use") apply to all contracts and other services of Digital Champion Poland Sp. Z oo, Francuska 37/35, 40-027 Katowice, Poland (hereinafter "Provider") and the users of the www.digitalchampion.net website and its subsites (hereinafter "Users").

These Terms of Use do not apply to contracts with customers.

Deviating regulations of the User do not apply unless the Provider has agreed to this in writing. In individual cases, agreements made with the User take precedence over the Terms of Use; for the content of which a written contract or the written confirmation of the Provider is authoritative. Legally relevant declarations and advertisements that are to be submitted by the User to the Provider after conclusion of the contract must be in writing in order to be effective.

The business relations between the Provider and the User are subject to the law of the Republic of Poland. The validity of international uniform law, in particular of UN sales law, is excluded.

Place of jurisdiction for all disputes between the parties arising from the contracts between them is Katowice. The Provider is also entitled to sue the User at her seat.

The language of the contract is English.

Services of the Provider

At www.digitalchampion.net, the Provider operates an information Website (hereinafter the "Website") at which Users can access information about Digital Champion Poland Sp z o.o. This information allows the User to make fact-based decisions on their own responsibility.

Although the Provider carefully identifies, processes and evaluates the information available at the Website, it cannot guarantee that the information obtained is invariably accurate and complete. The Provider also assumes no liability for the fact that a decision taken by the User on the basis of the information received at the Website leads to the expected success.

Conduct of the User

Each User is basically liable for all activities that are carried out using her User access and indemnifies the Provider from any claims for damages from third parties.

The provisions of the EU General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG 2018) are complied with.

Severability clause

If any provision of these conditions of sale is invalid, the remaining provisions remain unaffected. The ineffective provision shall be deemed to be replaced by one that comes closest to the meaning and purpose of the invalid provision in a legally effective manner. The same applies to possible regulation gaps.
